Welcome to HydroExVac (“we,” “us,” “our”). By accessing or using our website, products, or services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

1) Who we are

HydroExVac is owned and operated by Omega Diamond Inc., 10125 Ophir Rd, Newcastle, CA 95658, USA.

2) Eligibility and account

You must be the age of majority in your jurisdiction to purchase. Creating a store account is optional; signing up to our preorder list does not create a password-based account.

3) Products, specs, and availability

We strive to display accurate product information. Specs, materials, finishes, and availability may change without notice. Minor variations may occur due to manufacturing updates.

4) Pricing and taxes

Prices are shown in USD unless stated otherwise and may change at any time. Applicable taxes and shipping fees are calculated at checkout.

5) Orders and payment

An order is an offer to buy. We may accept, limit, or cancel any order including suspected fraud, address issues, or stock constraints. If we cancel after payment, we will refund you to your original method.

Refunds
Refunds for canceled or returned orders are issued to the original payment method after approval. Please allow 5 to 10 business days for processing after we initiate the refund.

6) Preorders and launch notifications

Our preorder signup currently collects email and optional name or phone number to notify you when HydroExVac is available for purchase.

No payment is collected at preorder signup.
Signup does not guarantee product availability or a specific ship date.

We may open sales first-come, first-served and will email participants when purchasing opens.

If we later introduce paid preorders or deposits, we will clearly disclose billing, timing, cancellation, and delivery terms on the product page at that time.

7) Shipping and lead times

We will ship to the address provided at checkout. Estimated processing and carrier timelines are shown at checkout and on our Shipping and Lead Times page when published. Estimates are not guarantees. Title and risk of loss pass to you once the carrier accepts the shipment.

8) Returns and Warranty

Returns
Unopened and unused products in original packaging may be eligible for return within 30 days of delivery. An RMA is required before sending anything back. Shipping charges are non-refundable and return shipping is the customer’s responsibility. We do not charge a restocking fee. Items showing wear, damage, modification, or operation outside rated specifications are not eligible. For an RMA, email admin@hydroexvac.com with your order number and photos if applicable.

12-Month Limited Warranty
This product is warranted against manufacturer defects in materials and workmanship for 12 months from the purchase date. This warranty does not cover normal wear and tear, damage from misuse, abuse, improper maintenance, unauthorized modification or repairs, operation outside rated specifications, or use contrary to the instructions and safety guidance provided on the product, in documentation, and on our website.

Rated limits
Do not exceed 5000 PSI or 4000 PSI when using the Turbo Nozzle.

Safe operation
Never aim at people, animals, or electrical devices. Wear appropriate PPE including eye, hand, and body protection. Depressurize and disconnect before service or nozzle changes. Inspect hoses and fittings before each use. Do not use if damaged or leaking.

Remedy
Our liability is limited to repair or replacement of the defective product at our discretion. Proof of purchase may be required.

Disclaimer
No other warranties including express or implied warranties of merchantability or fitness for a particular purpose are provided to the extent permitted by law.

9) Industrial equipment safety and proper use

HydroExVac is professional-grade equipment. You are responsible for using products only as intended and per manuals and instructions, ensuring proper training and PPE, complying with applicable laws and safety standards, and performing routine inspection and maintenance. Misuse voids the warranty and may cause injury or damage.

10) Prohibited uses

You may not use the Services or products for unlawful purposes, to violate regulations, to infringe intellectual property, to transmit malware, or to interfere with site operations.

11) Intellectual property

All content, trademarks, names, logos, product designs, documentation, and media are owned by us or our licensors. You may not copy, modify, or distribute without permission.

12) User content and reviews

If you submit reviews or materials, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for marketing and operations, subject to our Privacy Policy.

13) Third-party services

Our store is hosted by Shopify. Third-party tools or links you use are governed by their terms and privacy notices. We are not responsible for external sites.

14) Privacy

Your use of the Services is subject to our Privacy Policy and Your Privacy Choices. By submitting contact details including preorder signup, you consent to receive operational emails including confirmations and launch notices. Promotional emails are sent only where permitted. You may unsubscribe at any time.

15) Disclaimers

The Services and all content are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties including express or implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow limitations on implied warranties so these limitations may not apply.

16) Limitation of liability

To the maximum extent permitted by law, Omega Diamond Inc. and HydroExVac will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages including loss of profits, data, use, goodwill, or other intangible losses arising from or related to your use of the Services or products. Our aggregate liability will not exceed the amount you paid for the product giving rise to the claim.

17) Indemnification

You agree to indemnify and hold harmless Omega Diamond Inc., its officers, employees, and agents from claims arising out of your misuse of the products or violation of these Terms.

18) Governing law and venue

These Terms are governed by the laws of the State of California without regard to conflict-of-laws rules. Exclusive venue lies in the state or federal courts located in Placer County, California or the nearest competent venue. You consent to personal jurisdiction there.

19) Changes to the Services or Terms

We may update products, features, and these Terms at any time. When we do, we will update the date above. Continued use of the Services after changes means you accept the revised Terms.
